PERSONAL DATA PROTECTION INFORMATION TEXT:
This information text is prepared for the purpose of enlightening the data subjects regarding the procedures and principles of processing the Personal Data of patients/consultants who apply to FULDAN BAYSAL CLINIC, in accordance with the Turkish Legal legislation, Personal Data Protection Law No. 6698 (“KVKK”), and the General Data Protection Regulation (“GDPR”). Ensuring the security of patients’/consultants’ Personal Data is a priority objective of THE DOCTOR. Therefore, necessary security measures are taken by FULDAN BAYSAL in compliance with the existing legislation, to process the patients’/consultants’ Personal Data securely and to prevent any illegal access or leakage that may occur. DATA CONTROLLER: Your Personal Data will be processed by FULDAN BAYSAL, operating at the OFFICIAL ACTIVITY address, within the scope of Law No. 6698 and GDPR. Within the scope of FULDAN BAYSAL, it is considered as “Data Controller” and under GDPR, it is considered as “Controller”. FULDAN BAYSAL has contracted a Law Firm specialized in Personal Data Protection as the “Data Protection Officer” under GDPR, and the Compliance Process Related to the Protection of Personal Data within FULDAN BAYSAL CLINIC under KVKK and GDPR has been carried out under the consultancy and guidance of the lawyer, with the responsibility remaining with the Data Controller.
YOUR PERSONAL DATA TO BE PROCESSED:
Your Personal Data and Specially Qualified Personal Data listed below will be processed by FULDAN BAYSAL CLINIC in a lawful manner, connected and limited to the purpose of processing, respecting the principles of justice and transparency, accurately and up-to-date, by taking all technical and administrative measures foreseen in the legislation for ensuring data security, in accordance with the basic principles envisaged in KVKK Art.4 and GDPR Art.5, within the Personal Data Processing Conditions and Purposes stated in KVKK Articles 5 and 6 and GDPR Articles 6 and 9, and within the purposes included in this Information Text.
THE PURPOSE OF PROCESSING YOUR PERSONAL DATA:
Your Personal Data and Specially Qualified Personal Data will be processed for creating a patient file, conducting examinations, preventive medicine, medical diagnosis, treatment, medical intervention, operation and care services, conducting your medical practices, performing controls after medical diagnosis and treatment and/or operation processes, managing possible complication processes, contacting you directly, conducting appointment processes, managing patient satisfaction and demands, fulfilling legal and contractual obligations, preserving the health data that needs to be stored according to the related legislation for specified durations, ensuring the security of the medical practice, obtaining consultation services from other relevant specialist doctors when necessary, fulfilling legal obligations in accordance with International Health Tourism Legislation, planning transfer and accommodation services for Health Tourist patients within the framework of International Health Tourism, announcing innovations related to medical treatment and applications, informing third parties about the medical services provided, conducting promotion and marketing activities related to the medical services offered within the framework of the International Health Tourism Incentive Legislation, planning and managing health services and their financing, fulfilling responsibilities arising from the legal relationship established between the doctor and the patient, fulfilling financial and administrative obligations, ensuring technical security, and fulfilling public obligations, in compliance with KVKK and GDPR, by FULDAN BAYSAL CLINIC.
Your Personal Data and Specially Qualified Personal Data will be processed by FULDAN BAYSAL CLINIC under KVKK and GDPR in the following situations and conditions: Your Identity Data; will be processed for conducting examinations, preventive medicine, medical diagnosis, treatment, operation and care services, creating a patient file, managing patient satisfaction and demands, planning transfer and accommodation services for Health Tourist patients/consultants within the framework of International Health Tourism.
Your Contact Information; will be processed to perform controls after medical diagnosis, treatment and operation processes, to manage appointment processes, and additionally, subject to your explicit consent, to introduce, inform, and announce innovations related to medical treatment, medical practices, and operations, to remind you of the upcoming appointment date in ongoing treatments, and to send greetings and celebrations on special days.
Your Health Information; will be processed to successfully perform your medical treatments and operations, to obtain consultation from another specialist doctor if necessary during your treatment process, to manage the complication process, to create a patient file, to preserve the information related to the health data that needs to be stored according to the related legislation for specified durations, to fulfill legal obligations under the current Health Law and Health Tourism Legislation. Your Photo, Video, and Audio Recording Information will be processed by FULDAN BAYSAL to manage the treatment process by observing it, to ensure the security of the medical practice, and additionally, subject to your explicit consent, within the scope of International Health Tourism, to inform Health Tourist third parties seeking treatment in our country, in accordance with the Health Tourism Incentive Legislation, about the medical procedures and/or operations applied, and can be published on the clinic/doctor’s INSTAGRAM, FACEBOOK, TWITTER accounts, the doctor’s official website, the clinic/medical practice’s website in a way that your face is visible and recognizable in an ethical and legal manner. Personal data will also be published in an anonymized form (anonymization) in such a way that it cannot be associated with any identifiable or identifiable real person, even when matched with other data. The nature of the processed region will be determined by the doctor’s will in accordance with ethics and law.
Your Financial Data; will be processed to control your payments and issue invoices, and in case of any excess payment, for the purpose of refund. Your Transfer and Accommodation Information; will be processed to plan the transfer and accommodation services for patients/consultants coming within the framework of International Health Tourism. Your Personal Data and Specially Qualified Personal Data mentioned above will be processed for the purposes and in accordance with the legislation mentioned above, in order to be able to perform your medical treatment and/or operation and to fulfill the obligations related to your treatment. If you do not provide your relevant personal data, the legal obligations of FULDAN BAYSAL CLINIC, which will serve as a doctor in your operation and medical treatment, cannot be properly fulfilled, and your operation/treatment and recovery processes cannot be successfully conducted.
METHOD OF COLLECTION OF YOUR PERSONAL DATA:
Your Personal Data, in connection with the health services provided by FULDAN BAYSAL; will be collected through the health reports you provide for medical evaluation related to the treatment to be applied when you visit the medical practice for examination, treatment, and/or operation purposes, your laboratory and imaging results, your analyses, and other health data statements, by filling out the “Patient Information and Consent Form” related to the treatment and/or operation to be applied by the Doctor, through the contact form you fill out on the corporate website of the Doctor, through electronic mails sent to the corporate email address of the Doctor, through photo/video recordings taken by the Doctor before, during, and/or after the medical procedure applied to you, upon your request and when necessary; for the purpose of diagnosing and checking your condition remotely by the Doctor, by using remote connection applications service providers (whatsapp/zoom.us/facetime/skype/messenger/google/instagram/facebook etc.) that you use, having accepted their Privacy Policies and Data Transfer Principles, by sending written/audio/visual (photo and/or video recording) messages to FULDAN BAYSAL and through online audio/visual calls established through these applications, by accepting the Privacy Policies and Data Transfer Principles of the currently used remote connection applications service providers (whatsapp/zoom.us/facetime/skype/messenger/google/instagram/facebook etc.), whose servers are located abroad, and by sending written/audio/visual (photo and/or video recording) messages to FULDAN BAYSAL or making audio/visual calls or requesting remote examination/diagnosis services through these means; when you send direct messages to the profile account of FULDAN BAYSAL located on social media accounts (instagram, youtube, facebook, twitter, linkedin etc.) whose servers are located abroad, which you are currently a user of, having accepted their Privacy Policies and Data Transfer Principles, by participating as a guest user in the wireless internet network (wi-fi) present in the Doctor’s medical practice, if you wish to do so, through log-recording devices (firewall) used under the technical measures required by the regulations, for the purpose of ensuring workplace security, through security cameras under closed-circuit recording, will be collected and processed in accordance with KVKK and GDPR for the purpose of fully and properly fulfilling the contractual and legal obligations of FULDAN BAYSAL during the examination, preventive medicine, medical diagnosis, operation, treatment, and care services.
PURPOSE, METHOD, AND LEGAL REASON FOR THE PROCESSING OF YOUR PERSONAL DATA:
Your Personal Data, by real or legal persons authorized by FULDAN BAYSAL as “DATA PROCESSOR/PROCESSING”; will be processed by recording it physically and electronically with the necessary technical and administrative security measures, in verbal, written, camera and photo recording, and additionally, in cases foreseen by the relevant provisions of KVKK and GDPR, your explicit consent will also be obtained.
CASES REQUIRING THE OBTAINING OF YOUR EXPLICIT CONSENT:
In accordance with GDPR Article 6/1/a and KVKK Article 5/1, in the cases specified below, your Personal Data will be processed only by obtaining your explicit consent; Sending sms messages and/or emails to you and establishing mobile communication for the purpose of promoting, announcing, and informing about the medical services provided by the Doctor will only be possible by obtaining your explicit consent.
